TERMS & CONDITIONS
TERMS & CONDITIONS

These Terms & Conditions ("T&C") govern the rights and obligations of B Fitness Asia Sdn. Bhd. (1204067-X), and its subsidiaries, affiliates and studio brands operating under the Babel Group, including Babel, Tone, BossFit, Babel Academy and Babel Dance (collectively, "Babel"), and the individual accepting these T&C ("Member", "you"). This is a single agreement covering all Babel Group brands and applies to all services, packages, classes, personal training, workshops, passes and facilities you purchase or use now or in future, unless a brand-specific or service-specific term is stated otherwise.

These T&C apply to your conduct on Babel's premises — including fitness centres, studios, outdoor areas, swimming pools, and parking areas under Babel's ownership or control ("Premises") — and during any Babel programmes, classes, training, workshops or events held off-Premises ("Events").

By having a membership and/or any access to Babel Group’s premises, you confirm you have read, understood and agree to be bound by this entire document, including the House Rules, Personal Training terms, and Privacy Policy set out below.

1. MEMBERSHIP

1.1  Unless otherwise stated in this T&C, membership is personal to the individual signed up and is non-assignable, non-refundable and non-transferable.

1.2  The Management reserves the right to decline any membership application for any reason whatsoever.

1.3  Members are required to pay a Joining Fee where applicable, and Membership Fees as specified at the point of purchase. Fees, packages and pricing are subject to change from time to time as stipulated by Babel, with notice given in writing (see Section 18).

1.4  Joining Fees and Membership Fees are not refundable upon termination of membership for any reason, except as set out in Section 3 (Refund & Fee Policy).

1.5  All memberships, regardless of payment plan, are subject to auto-renewal upon completion of the contracted membership period, unless cancellation is requested in accordance with Section 5.

1.6  Babel reserves the right to charge a late payment fee, at the rate stipulated by Babel from time to time, for membership dues unpaid beyond a stipulated period.

2. MINORS & GUARDIAN CONSENT

2.1  The minimum age to independently register for Babel membership is 16 years old.

2.2  Members who are 16 or 17 years of age at the time of registration must provide the full name, contact details, and relationship of a parent or legal guardian, and that parent or legal guardian must separately review and sign this agreement (including the Personal Fitness Declaration and Limitation of Liability in Sections 12 and 13) on the minor's behalf before membership is activated.

2.3  The parent or legal guardian signing on behalf of a minor member is jointly responsible with the minor for all obligations under this T&C, including payment obligations, for the duration of the minor's membership.

2.4  Babel does not accept membership registrations from individuals under 16 years of age. Separate rules on facility access for children under 16 who are not members are set out in Section 8 (House Rules).

3. REFUND & FEE POLICY

3.1  Membership fees, joining fees, freezing fees, cancellation fees, and personal training or workshop session fees are non-refundable under any circumstances, except where mandated by law. This includes, without limitation: (a) member-initiated termination for any reason; (b) unused personal training or class sessions; and (c) facility closures, temporary disruptions, or other unforeseen circumstances.

3.2  Refund requests will only be considered in cases of billing error or as required by law. All requests must be submitted in writing to hello@babel.fit and are subject to Management's review and approval.

3.3  All fees referenced in this T&C (including but not limited to freezing fees, cancellation fees, late payment fees, and towel replacement fees) are charged at Babel's prevailing rates as published from time to time via the Babel App, in-club notices, or Babel's official website. Babel will provide written notice of any change to these rates in accordance with Section 18.

4. FREEZING

4.1  Members must submit a freezing request in writing (via the Babel App or email to hello@babel.fit) at least seven (7) days prior to the start of the freeze period, with a minimum freezing term of two (2) weeks.

4.2  Complimentary freezing weeks, where applicable, are granted in accordance with the Member's package as stated at point of purchase.

4.3  Freezing beyond any complimentary allocation will be charged at Babel's prevailing freezing fee rate (see Section 3.3).

4.4  No back-dated freezing is allowed. All freeze requests must be submitted at least seven (7) days prior to the intended freeze start date. Membership will reactivate automatically at the end of the freeze period unless an extension is requested in writing.

4.5  Members on a 1-Month Introductory membership, complimentary membership, or 1-on-1 PT-only package are not eligible for freezing.

4.6  Members cannot access Babel facilities or services during an active freeze period.

4.7  Freezing requests for personal training packages must align with this freezing policy (minimum two-week freeze, seven days' notice); PT session expiry dates are extended accordingly.

4.8  If a Member is found to have used any Babel facility or service during an active freeze period, Babel reserves the right to charge the applicable fees for that period as if the membership had not been frozen, and/or to reverse the freeze in full.

5. CANCELLATION

5.1  Comfort Guarantee: all new Members are entitled to a “comfort guarantee” period of fourteen (14) days from the contract sign-up date, during which they may request cancellation of their membership in accordance with Section 5.2, and no early termination fee shall be charged. A “new Member” means a new joiner, and does not include renewals, auto-renewals, upgrades, or returning Members whose previous membership ended within the preceding six (6) calendar months. A Member who exercises the comfort guarantee must make the request within the 14-day period; the membership will end fourteen (14) days from the contract sign-up date, and the requirement to return the membership card under Section 5.5 continues to apply. No refund of any kind will be given to a Member who exercises the comfort guarantee: all fees paid, including joining fees, membership fees paid in advance (such as monthly fees) and personal training fees, are non-refundable regardless of whether they are unused.

5.2  Members must submit a cancellation request in writing (via the Babel App or email to hello@babel.fit), stating the reason for cancellation.

5.3  Except where Section 5.1 applies, cancellation requests must be made at least seven (7) days prior to the next billing date.

5.4  Subject to Section 5.1, cancellation of a membership before completion of its minimum contract period will incur a cancellation fee at Babel's prevailing rate (see Section 3.3).

5.5  The Member must settle all outstanding payments and return any membership card or access device before cancellation is processed.

5.6  All memberships are subject to auto-renewal and will not be automatically cancelled upon completion of the contracted membership period. See Section 6 for how continued or non-usage of the membership is treated.

5.7  Babel reserves the exclusive right, at its sole discretion, to terminate any Member's membership and restrict or prohibit future access to Babel's facilities and services, including where the Member has violated Babel's policies, this T&C, or where their conduct is unlawful, unethical, or detrimental to the safety, reputation, or operational integrity of Babel.

5.8  Grounds for termination and restriction of access include, but are not limited to: acts of misconduct, harassment, non-payment of fees, unauthorised use of proprietary materials, or any behaviour contravening applicable laws, regulations, or Babel policies.

6. CONTINUED MEMBERSHIP, NON-USAGE & AUTO-RENEWAL

6.1  Non-usage or non-visitation of Babel facilities does not constitute notice of cancellation and does not suspend or waive the Member's payment obligations. Membership fees will continue to be charged on the agreed billing schedule regardless of whether the Member visits or uses any Babel facility or service.

6.2  Unless and until cancellation is requested in writing in accordance with Section 5, both continued usage and non-usage of Babel's facilities, classes, or any affiliate or subsidiary service constitute the Member's ongoing agreement and consent to (a) remain bound by this T&C, and (b) continued billing under the Member's chosen payment method, including auto-renewal and auto-debit.

6.3  By providing a payment method, the Member authorises Babel to charge the applicable membership fees, and any other fees due under this T&C, on an auto-billing and auto-renewal basis for as long as the membership remains active and has not been cancelled in writing.

6.4  For as long as an individual remains a Member, they remain bound by this T&C, including any amendments made under Section 18. Babel's obligation is to provide notice of any amendment through the channels described in Section 18; Babel is not responsible for ensuring that a Member has actually seen, read, or acknowledged such notice, provided Babel has made reasonable efforts to communicate it through those channels.

7. PERSONAL TRAINING SERVICES

Personal training ('PT') services purchased at any time, whether at registration or subsequently, are governed by this T&C as a single blanket agreement. No separate Personal Training Agreement is required to be signed at the time of PT purchase — this Section 7 applies automatically to all PT packages held by the Member, now or in future.

7.1  Babel Fitness Instructors/Trainers are not licensed medical professionals. The Member agrees to promptly and fully disclose to their Trainer or any authorised Babel representative any injury, condition, or impairment which may affect the personal training programme. The Trainer may discontinue training if a condition is discovered that presents a risk to the Member, the Trainer, or others, including conditions not previously disclosed.

7.2  PT fees are payable in advance, at least three (3) days prior to the scheduled session, via the Customer Service Counter or the Babel App. Members may not pay a Trainer directly.

7.3  PT sessions have an expiration date as stated in the package purchased. Sessions not utilised before expiry are forfeited, without refund, subject to Section 4.7 (freezing).

7.4  Session timing is agreed between Trainer and Member. Late arrival does not extend the session — it will end at the originally scheduled time.

7.5  Members must give at least twenty-four (24) hours' notice to reschedule or cancel a PT session. Failure to do so, or tardiness of more than fifteen (15) minutes, will result in forfeiture of that session with no refund.

7.6  If the assigned Trainer cancels within the 24-hour notice period, Babel will provide a substitute Trainer for the affected session(s).

7.7  A Member with substantiated, reasonable grounds for dissatisfaction with their Trainer may request a different Trainer, subject to Babel's discretion and availability.

7.8  All PT fees are non-refundable, regardless of whether the Member completes the sessions purchased.

7.9  Members must verify each session through Babel's designated session verification process (via the Babel App or such other method as Babel may implement from time to time).

7.10  Babel may assign a different Trainer at any time without prior notice, and may vary PT rates and terms from time to time; changes will not affect the rate or terms of packages already purchased before the change takes effect.

7.11  Individual results vary based on factors including body type, nutrition, lifestyle, and programme adherence. No specific outcome or timeline is guaranteed.

7.12  Members must not be under the influence of drugs or alcohol during any training session and must wear appropriate athletic attire; Babel may decline to commence a session if attire poses a safety risk.

7.13  Members may not bring guests or unauthorised individuals to PT sessions without Babel's prior written approval.

7.14  The Member agrees not to solicit, engage, or hire any Babel Trainer for private sessions outside of Babel without Babel's prior written approval. Breach of this clause results in immediate termination of the Member's contract without refund, and the Member may be liable for damages.

7.15  A Trainer is not liable for injury, illness, or damage arising from a PT session except where directly attributable to the Trainer's gross negligence or wilful misconduct. The Member agrees to indemnify and hold harmless the Trainer and Babel from claims arising from the Member's participation.

7.16  Package Expiry Extensions: the expiration date of any package across Babel Group brands (including, without limitation, PT, physiotherapy, and reformer/studio session packages) is final and will not be extended, except in either of the following circumstances: (a) for verified medical reasons, supported by documentation acceptable to Babel; or (b) where the package is validly frozen under Section 4 (Freezing), in which case the expiry date is extended by the duration of the approved freeze period only. No other reason will be accepted for extending a package's expiry date.

8. HOUSE RULES

All Members and guests must comply with the following House Rules at all times. These rules form part of this T&C and a breach of them may result in restriction of access or termination of membership under Section 5.

8.1  Check-In & Club Access

8.1.1  Members must check in upon every entry to a Babel outlet, using one of the following methods: (a) facial ID recognition, where the Member has registered for this at the outlet; (b) their membership card or App-based digital pass; or (c) manual check-in at the front desk, for Members who have not registered for facial ID or do not have their membership card or device on hand. Check-in is a condition of access to Babel facilities.

8.1.2  Members may access facilities within stated operating hours only.

8.1.3  Children under 16 years of age are not permitted on the gym floor, except in designated lounge areas, and must be accompanied by a Member or guardian at all times.

8.1.4  Babel is not liable for any injuries, damages, or incidents occurring on its Premises, subject to Section 13 (Limitation of Liability).

8.2  Group Classes

8.2.1  All group classes must be booked in advance through the Babel App.

8.2.2  Members must arrive at least 10 minutes before the scheduled class start time. Doors will be locked 5 minutes after the class begins; latecomers will not be admitted.

8.2.3  All bookings are non-refundable. A late cancellation is treated as a no-show and any fee paid is forfeited.

8.2.4  For Tone classes specifically, the minimum cancellation window is twelve (12) hours before the scheduled class start time. Any cancellation made less than 12 hours before the class, or any no-show, will result in forfeiture of the class credit used for that booking.

8.2.5 Babel may change the time, venue, instructor or type of any class, or cancel a class, due to unforeseen circumstances or operational requirements. Babel will make reasonable efforts to notify affected Members through the Babel App, email or on-site announcements, but Members are encouraged to check the latest schedule before attending. Where Babel cancels a class, the class credit used for that booking will be returned to the Member. Babel is not otherwise liable for any inconvenience or loss arising from such changes, including missed sessions or dissatisfaction with a substitute instructor.

8.3  Babel Socials & Events

8.3.1  Babel Socials are included as a membership perk unless additional payment is communicated in advance for a specific event.

8.3.2  Members who fail to give at least 3 hours' cancellation notice before a scheduled Social will be restricted from booking Socials for the next three (3) events.

8.4  Changing Rooms

8.4.1  Lockers are for daily use only, unless the Member has been allocated a designated locker under their package.

8.4.2  Members must maintain proper hygiene and follow sauna rules, including use of a towel and keeping noise to a minimum.

8.4.3  Filming or photography in changing room areas is strictly prohibited. Violation may result in immediate termination of membership.

8.5  Gym Floor & Facilities

8.5.1  Members must re-rack weights after use and report any faulty equipment to Management or the Customer Relations Officer on duty.

8.5.2  Members must sanitise equipment after use to maintain hygiene for other users.

8.5.3  Members must adhere to all posted signage and wear appropriate workout attire; Babel may deny entry if attire is deemed inappropriate.

8.5.4  Members must not hog machines or occupy space unnecessarily, and must not film or photograph other members without their consent.

8.5.5  No food is permitted on the gym floor or in workout areas; food may only be consumed in designated lounge or café areas.

8.6  Swimming Pool (where applicable)

8.6.1  Appropriate swimwear must be worn at all times.

8.6.2  Floatation devices, toys, water guns, or similar items are not permitted in the pool area.

8.7  Towel Services

8.7.1  Face towels are available at the front desk; shower towels are provided in the respective locker rooms.

8.7.2  Members who fail to return a towel will be charged a replacement fee at Babel's prevailing rate (see Section 3.3).

8.8  Smoking & Vaping

8.8.1  Smoking or vaping is strictly prohibited within Babel Premises. Violation may result in immediate termination of membership at Babel's discretion.

Members must at all times abide by all rules of the Club as written, stated, published, or displayed at Babel's Premises or on the Babel App, which may be amended, varied, added to, or removed from time to time at Management's discretion, subject to Section 18 (Variation and Amendment).

9. DAY PASS & NON-MEMBERSHIP PASSES

9.1  Day Pass

9.1.1  A Day Pass grants access, for the stated day only, to the facilities of the specified outlet, subject to availability and Babel's sole discretion where equipment or facilities are under maintenance, unsafe, or otherwise restricted.

9.1.2  A Day Pass is valid for one (1) individual only and is non-assignable, non-refundable, and non-transferable once assigned.

9.1.3  Day Pass holders are subject to this entire T&C, including House Rules; Babel may refuse entry or terminate the pass immediately for any violation.

9.1.4  Class bookings may be made over the counter or by phone, opening three (3) days in advance; spaces are not guaranteed.

9.1.5  Day Pass holders are not entitled to membership perks (e.g., partner discounts).

9.1.6  Day Passes are not refundable for any reason and are not available for resale.

9.2  Non-Membership Pass (Dance & Reformer)

9.2.1  Non-Members may purchase a Non-Membership Pass for selected services, including Babel Dance classes and Reformer Pilates sessions at Tone Boutique Studio.

9.2.2  Non-Membership Pass holders are entitled to locker rooms, showers and toilets as part of their pass, and may book classes at the specified outlet, valid in accordance with the expiry of the pass or package purchased.

9.2.3  The Non-Membership Pass is non-assignable, non-refundable and non-transferable once assigned, and the holder is subject to this entire T&C.

9.2.4  In the event of overbooking, the holder will be offered an alternative date and/or time for the same class. Passes are not refundable for any reason and are not available for resale.

10. BABEL ACADEMY (WORKSHOPS)

10.1  This section applies to any individual or entity ("Client") registering for programmes, courses, workshops or events organised under Babel Academy ("Workshops").

10.2  Registration is a request to attend; it does not constitute a confirmed booking until full payment is received, processed and verified. Babel may reject any application for any reason.

10.3  Where Babel acts as distributor, administrator, agent or partner for a third-party Workshop, the Client agrees to that third party's terms; Babel assumes no responsibility for the content, quality, delivery or certification of such Workshops.

10.4  The Client may cancel a Workshop registration with at least fifteen (15) business days' written notice; no refund will be issued regardless of the timing of cancellation. Less than the required notice means the full fee remains payable.

10.5  Babel may cancel, reschedule, or rearrange a Workshop at its discretion due to unforeseen circumstances, operational requirements, or insufficient enrolment. In such cases, or where the Client cannot attend the rescheduled date, Babel will issue a full refund within 14 business days.

10.6  Babel's liability for Workshop cancellation or rescheduling is strictly limited to a refund of the fee paid; Babel is not liable for indirect costs such as travel or accommodation.

10.7  Where maximum class capacity is exceeded, Babel will offer the Client a refund for that class or credits toward other Babel products/services, subject to an expiry period set by Babel.

10.8  Babel may exclude any Client from a Workshop for disorderly conduct or failure to follow Babel's rules; the fee remains chargeable and non-refundable in such cases.

10.9  Babel may photograph or film Workshops for marketing purposes and may use such material on its website, App, or social media.

10.10  All intellectual property in Workshop materials remains the exclusive property of Babel and/or its licensors. The Client receives a non-exclusive, non-transferable, non-sub-licensable licence to use such materials solely to receive the Workshop, and may not reproduce, copy, or translate any part of them.

11. CORPORATE PARTNERSHIPS

11.1  In addition to this T&C, corporate membership packages are subject to terms agreed in writing between Babel and the corporate partner from time to time.

11.2  Babel may revert a corporate membership to standard pricing if corporate eligibility requirements cease to be met (e.g., the Member is no longer employed by the corporate partner, or the partner no longer meets Babel's minimum account requirements).

11.3  For corporate memberships with a fixed contract term, early termination requires settlement of all outstanding payments and the remaining fees for the contracted period.

12. PERSONAL FITNESS DECLARATION

12.1  Before participating in any fitness activity or using Babel's facilities, you are strongly advised to obtain medical clearance from a qualified healthcare professional if you have any pre-existing condition — including but not limited to cardiovascular, respiratory, musculoskeletal, neurological, or metabolic conditions — or any other health concern that may affect your ability to safely exercise.

12.2  This also applies if you are pregnant, have recently given birth, have undergone recent surgery or medical treatment, are over 40 and have not exercised regularly for an extended period, or are otherwise unsure of your physical capability to participate.

12.3  You must comply with all Club rules, safety instructions, and warning notices displayed on the Premises, and use equipment and facilities responsibly. If you experience discomfort, pain, dizziness, or any adverse symptom, you must stop immediately and inform Club staff.

12.4  Babel does not provide medical assessments, advice, or services, and assumes no responsibility for the medical needs or physical condition of its Members.

12.5  Participation in any fitness programme or use of Babel's facilities is entirely at your own risk, and it is your sole responsibility to ensure you are physically fit and capable of engaging in such activities.

13. LIMITATION OF LIABILITY

13.1  By attending any class, Event, or activity, or using any training facility or equipment, you acknowledge — on behalf of yourself, your heirs, and personal representatives — that you assume all inherent risks of physical activity, including but not limited to personal injury, property damage, and equipment malfunction. You agree to assume full responsibility for yourself and for any injury or damage sustained or aggravated in relation to your use of Babel's equipment or facilities, and agree to release, indemnify, and hold Babel harmless from any related claims, except where prohibited by law.

13.2  Babel accepts no responsibility for loss or damage to Members' or guests' property, or for death or injury sustained on the Premises. Members and guests agree that no claim will be made against Babel, Management, or staff for any reason whatsoever.

13.3  Babel, its associated companies, employees or agents are not responsible for any claim, demand, injury, damage, or negligence action arising from death, injury, loss, damage, or theft of a Member's person or property in connection with the use of Babel's services or facilities. The Member holds Babel and its associated parties harmless from all such claims. Any guest or temporary visitor is bound by the same Club rules and limitation of liability as a Member. All prices quoted are subject to prevailing taxes.

14. LIABILITY AND CONDUCT DISCLAIMER

14.1  Babel is committed to maintaining a safe and respectful environment for all Members, employees, and visitors. Babel strictly prohibits any form of misconduct as defined under the Anti-Sexual Harassment Act 2022. Members are encouraged to report any incidents to a Babel representative for immediate and appropriate action.

14.2  Babel employs measures to prevent harassment, including policies, staff training, and feedback mechanisms. You acknowledge and agree that Babel shall not be held vicariously liable for acts of harassment committed by its employees, agents, or representatives that occur outside the course and scope of their employment or duties.

14.3  By agreeing to this T&C, you agree to release Babel from liability arising from such acts, except where it is established that Babel was negligent in addressing a reported case of harassment within the workplace or during official Babel activities. Babel reserves the right to take disciplinary action against any individual found responsible for harassment, in line with applicable law and company policy.

15. PAYMENT TERMS AND BILLING

15.1  Pay-Monthly Memberships: the membership fee and any related charges (e.g., taxes, transaction fees) are billed monthly to the Member's Payment Method on the calendar day corresponding to the start of membership ("Billing Date"); in some cases this date may shift (e.g., to align with the Member's first visit).

15.2  Prepaid Memberships (3, 6, or 12 months): the membership automatically converts to a Pay-Monthly membership at the end of the prepaid term. Members who wish to terminate a prepaid membership must notify Babel in writing at least seven (7) days before the next billing date.

15.3  Corporate Packages: validity is subject to Babel's and the corporate partner's requirements (see Section 11).

15.4  Members must provide a valid Payment Method. By adding a Payment Method, the Member authorises Babel to charge applicable fees (see also Section 6). If the primary Payment Method fails, Babel may charge any other Payment Method associated with the Member's account. Members are responsible for ensuring payments are successfully collected.

15.5  Babel may modify membership plans and pricing from time to time, as stipulated by Babel, with notice given in writing in accordance with Section 18.

16. MISCELLANEOUS

16.1  Soliciting or selling memberships, private personal training, merchandise, or retail products to any Member is prohibited and will result in immediate termination of the Member concerned, without refund.

16.2  Failure by Management to enforce any right under this T&C at any time shall not be construed as a waiver of that right.

16.3  Babel reserves the right to use individual or group photographs of Members and/or guests for press or promotional purposes.

16.4  Members and guests may not photograph or copy Babel's club interior designs, promotional materials, taglines, or theme.

16.5  All members must abide by the rules of Babel, which may be amended, varied, deleted, or added from time to time at Management's discretion, subject to Section 18.

16.6  Babel reserves the right to pursue legal action against any Member found distributing, sharing, or supplying Babel's proprietary content to a third-party vendor or competitor.

16.7  All intellectual property, including but not limited to proprietary materials, training programmes, instructional content, trademarks, trade names, service marks, logos, designs and other creative or proprietary assets associated with Babel, remains at all times the sole and exclusive property of Babel.

16.8  In the event that any Babel outlet ceases operations, temporarily or permanently, no refund will be provided for membership fees, joining fees, or other payments made by Members, regardless of the reason for closure, except as required by law.

16.9 This T&C, together with the package, pricing and contract details stated at the point of purchase, forms the entire agreement between the Member and Babel. No verbal statement, promise, representation or assurance made by any staff, trainer or representative of Babel, whether before or after sign-up, is valid or binding on Babel unless it is recorded in writing and confirmed by Babel Management. Babel makes no implied warranties or representations other than those expressly stated in this T&C.

17. GOVERNING LAW

17.1  This T&C is governed by and construed in accordance with the laws of Malaysia, and the parties submit to the exclusive jurisdiction of the courts of Malaysia.

18. VARIATION AND AMENDMENT

18.1  Babel reserves the right to vary, amend, or modify this T&C, and any fees or rates referenced in it, at its discretion.

18.2  Babel will provide notice of any such change in writing through one or more of the following channels: the Babel App, email to the Member's registered address, notices displayed at Babel's Premises, or Babel's official website.

18.3  Continued use of Babel's facilities and services after such notice has been given constitutes acceptance of the revised terms. It remains the Member's responsibility to review updated terms made available to them; as set out in Section 6.4, Babel's obligation is to provide notice through the channels above, not to guarantee actual receipt or review by the Member.

18.4  Where a Member does not agree to a material change, their remedy is to cancel their membership in accordance with Section 5 before the change takes effect; continued use or non-cancellation constitutes acceptance.

19. PRIVACY POLICY

Babel is committed to safeguarding your privacy in compliance with the Personal Data Protection Act 2010 (PDPA) and other applicable laws. This Privacy Policy explains how Babel collects, uses, discloses, stores and protects your personal information across our Premises, website, social media, and the Babel App. By using Babel's services, you confirm you have read, understood, and agree to this Privacy Policy, and consent to the collection, use and disclosure of your personal data as described below.

19.1  Scope

This Policy applies to personal information collected via membership registration, fitness assessments, in-person interactions, the Babel website and App, official social media, and online forms, surveys, promotions or enquiries.

19.2  Information We Collect

(a)  Personal identifiable information: full name, NRIC/passport, date of birth, gender, contact details, and payment information.

(b)  Health and fitness information: medical history, fitness goals, assessments, session records, and progress reports.

(c)  Technical information: device data, IP address, and App/website usage data.

(d)  Communications and feedback: messages, enquiries, surveys, and reviews.

(e)  Visual and biometric information: CCTV recordings for security; and, where you opt in, photo and/or facial ID data for the purpose of facility entry (see Section 19.2.1); and photos, videos or other biometric data used with your explicit consent for promotions or fitness tracking.

19.2.1  Facial ID for entry is optional. Facial ID recognition is Babel's primary recommended method of check-in, but it is not compulsory: Members may decline to register for facial ID and instead use their membership card, App-based digital pass, or manual check-in at the front desk (see Section 8.1.1), without any loss of access or membership benefits. Facial ID data will only be collected and used for entry purposes upon the Member's separate, explicit opt-in at the time of registration for this feature, and a Member may withdraw this consent and have their facial ID data deleted at any time by notifying Babel, after which they will check in using one of the alternative methods.

19.3  How We Use Your Information

To manage membership and payments; schedule sessions and classes; communicate service, schedule or billing updates; provide promotions and news; personalise fitness programmes and analyse App usage to improve our service; operate facility entry and access systems (including photo/facial ID verification where implemented); ensure facility security (e.g., CCTV); and comply with legal obligations.

19.4  Disclosure

Babel does not sell or trade personal information. We may share data with service providers and partners (e.g., payment processors, IT support) to deliver our services, with your consent for partner-brand offers, where required by law or regulatory demand, or to protect Babel's rights, property or safety, or those of others.

19.5  Security & Retention

Babel applies reasonable technical, physical and administrative safeguards, including secure storage, encryption of sensitive data, regular security reviews, and need-to-know access controls. Personal data is retained only as long as necessary for the purposes above or as required by law, after which it is securely deleted or anonymised.

19.6  Your Rights

Under the PDPA, you may request access to, correction of, or deletion of your personal data, and may withdraw consent for specific uses, subject to legal or contractual obligations. To exercise these rights, contact people@babel.fit; identity verification may be required.

19.7  International Transfers

Where personal data is transferred outside Malaysia, Babel ensures the receiving party complies with applicable data protection standards.

20. ACKNOWLEDGEMENT & SIGNATURE

By continued patronage of Babel and its subsidiaries — including by electronic signature via the Babel App and/or continued use of any B Fitness Group facilities and locations — I confirm that I have read, understood, and agree to be bound by this entire T&C, including the House Rules (Section 8), Personal Training terms (Section 7), Limitation of Liability (Section 13), and Privacy Policy (Section 19), as they apply to all Babel Group services I purchase or use now or in the future.

I consent to Babel collecting, using and disclosing my personal data as described in Section 19, and I authorise Babel to save my payment details and charge them on an auto-billing and auto-renewal basis as described in Sections 6 and 15, until I cancel my membership in writing in accordance with Section 5.
